1. Acceptance of Terms

By creating an account or using the Hoply mobile application or website (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

2. The Service

Hoply is an AI-powered running coach that generates and adapts personalized training plans based on data you log or sync from third-party services. The Service includes the mobile app, the website, our AI coach "Hoppy", and related features.

3. Eligibility

You must be at least 16 years old to use Hoply. By creating an account, you confirm that you meet this age requirement and that the information you provide is accurate and complete.

4. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@hoplyapp.com if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse engineer, decompile, or disassemble the app.
• Interfere with or disrupt the Service or its servers.
• Use the Service to harass, harm, or impersonate others.
• Scrape, mine, or extract data from the Service without permission.
• Resell, sublicense, or commercially exploit the Service.

7. Subscriptions, Billing and EULA

Hoply is free to download and includes core features. Optional paid subscriptions unlock advanced coaching features and are billed through your Apple ID.

• Monthly subscription: $6.99 per month.
• Annual subscription: $49.99 per year.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your Apple ID account settings.
• Pricing and subscription options are displayed in the app before purchase.
• Refunds are handled by Apple in accordance with their policies. You can request a refund at reportaproblem.apple.com.

Your licence to use the Hoply iOS app is also governed by Apple's standard Licensed Application End User Licence Agreement (the "Apple EULA"). Where these Terms and the Apple EULA conflict, the Apple EULA prevails for App Store-related matters.

8. Intellectual Property

The Service, including all software, designs, logos, and content provided by us, is owned by Hoply and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial use.

Training data you log remains yours. By using the Service, you grant us a limited licence to process that data to provide and improve the Service.

9. Third-Party Services

The Service may integrate with third-party services such as Apple Health. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party content or practices.

To provide coaching features, user inputs and training data may be processed by third-party AI service providers acting on our behalf.

10. Termination

You may stop using the Service and delete your account at any time from the app's settings or by emailing support@hoplyapp.com. We may suspend or terminate your account if you violate these Terms or misuse the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Hoply will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or €50 if you have not paid us anything.

Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for death or personal injury caused by our negligence).

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of your country of residence to the extent required by mandatory consumer protection rules; otherwise they are governed by the laws of the jurisdiction where Hoply is established. Disputes will be resolved in the competent courts of that jurisdiction, without prejudice to your statutory rights as a consumer.
